202000729 1 MotionMOTION, (AS AMENDED) submitted by Vice Mayor Smitherman and Councilmembers Kearney, Pastor and Young, The murder of George Floyd has revived a national conversation around institutional racism and implicit bias. As a result, we have witnessed demonstrations all across our country. We are committed to ensuring the right to *peaceably* assemble for all of our citizens. WE MOVE that the City *engage in the following efforts on a case by case basis for any person arrested solely for a curfew violation during the period of May 30, 2020-June 8,2020, by giving each such person arrested the following options: 1. Offers dismissal **with immediate order of expungement of misconduct at an emergency charge in exchange for a voluntary, written waiver of civil liability; or 2. Offer a reduced charge of disorderly conduct- minor misdemeanor and will indicate to the Court that the City has no objection to immediate expungement and waiver of City fines; or 3. Offer entry into the City's diversion program for curfew violations, in which an offender enters a plea of guilty to misconduct an emergency, c   Action details Not available
